WaterWatcher LLC (“WaterWatcher,” “we,” “our,” or “us”) collects and processes information that identifies you or can reasonably be linked to you, which we refer to in this privacy policy as “personal information.” This privacy policy describes how WaterWatcher collects, uses, discloses, and otherwise processes personal information, and it applies to personal information we collect or process about you through our mobile application, website, communications, and other interactions with you. WaterWatcher’s collection and processing of personal information is subject to applicable laws and regulations governing privacy and data protection, which are referred to in this privacy policy as “Data Privacy Laws.”

Children

The Service is not directed at individuals who are minors in the jurisdiction where they reside or who are under eighteen (18) years of age, and we do not knowingly collect personal information from such individuals. If we learn that we have collected personal information from such an individual without verifiable parental consent, we will take steps to delete that information from our systems as soon as reasonably practicable.

If you are a parent or legal guardian and believe that your child has created an account or provided us with personal information, please contact us at legal@waterwatcher.com so that we can take appropriate action.

Personal Information

WaterWatcher operates a fishing intelligence platform that provides AI-powered fishing condition reports, a speech-driven personal catch journal, and conservation data-sharing functionality for recreational anglers. The Service allows users to generate location-specific fishing condition reports based on real-time environmental data, log fishing catches and trips using voice recording, save and manage personal fishing spots, track historical fishing patterns over time, and optionally contribute anonymized catch data to community pattern matching and conservation science initiatives (collectively, the “Services”).

In connection with providing the Service and conducting our operations, we collect and process the following categories of personal information, including personal information we have collected and processed in the preceding 12 months.

  • Account and profile information, such as your email address, first and last name, profile name, home location (city or coordinates).
  • Payment and subscription information, such as your current subscription tier, subscription transaction records, and billing status. Payment card details are collected and processed directly by our third-party payment processor; WaterWatcher does not collect, process, or store your full payment card number, bank account number, or other financial account credentials.
  • Catch and trip information, such as species, count, size, weight, fishing method, location, and notes, entered manually or extracted from voice recordings and structured into your catch journal.
  • Voice transcripts, which is a written record of what you said during a catch log recording, from which your catch details are pulled and saved to your journal.
  • Location data, such as saved fishing spots and approximate catch locations derived from your selected spot or spoken landmarks. If you grant location permission, your device GPS coordinates may also be used to identify your fishing location. Event location data for catch, sighting, and observation events, generalized to within approximately one mile, may also be shared with conservation partners as described in the conservation data sharing section below. In addition, if you separately consent to sharing tag recapture data in connection with a tagged fish encounter, precise event location may be shared with the relevant conservation partner for that specific encounter, as further described in the conservation data sharing section below.
  • Pictures, specifically pictures you attach to a catch record, either taken within the application or uploaded from your camera roll. Photos are intended to accompany a catch entry and should relate to your fishing activity. Please do not upload photos containing sensitive personal information or images of individuals who have not consented to being photographed.
  • Usage data, such as information about how you interact with the application and website, including which features you use, actions you take within the Service, and general patterns of use.
  • Technological information, such as Internet Protocol (IP) address, device type, operating system, session identifiers, and other similar technological information collected in connection with your use of the Service or our website.

We collect personal information directly from you, including when you create or update an account, use or interact with the Service, make voice recordings, attach photos to catch records, engage with fishing spot selection, allow the application to capture your location or environmental conditions automatically during a trip, contact us for support or submit feedback, or otherwise engage with us online or offline. If you provide personal information about an individual other than yourself, such as a fishing companion mentioned in a voice recording or pictured in a photo, please ensure you have obtained any necessary consent or authorization before doing so. Do not provide us with personal information about another individual where you do not have the authority or consent to do so.

Sensitive Personal Information

WaterWatcher does not intentionally collect or process categories of information that are considered sensitive under applicable Data Privacy Laws, such as government-issued identification numbers, racial or ethnic origin, religious beliefs, health or medical information, or financial account credentials, except with respect to event location data as described in the conversation data sharing section below. The Service is limited to fishing intelligence and catch logging functionality, and the personal information we collect is intended to be limited to what is necessary to provide those Services.

However, there may be situations where you incidentally provide sensitive information, for example by uploading a photo that includes children or by mentioning personal details in a voice recording. We ask that you do not provide us with sensitive personal information through the Service. If you do so, you consent to our processing of that information to the extent necessary to provide the Service, and we will handle it with the same protections described in this policy.

With respect to voice data, when you use the speech-driven catch logging feature, your voice recording is processed for the purpose of transcribing what you said about your catch. By using this feature, you consent to the collection and processing of your voice recording for this purpose. We do not use your voice for any other purpose, and raw audio is not retained after transcription is complete. If this changes in the future, we will update this privacy policy accordingly and, where required by applicable law, seek your consent before processing any such information.

Use of Artificial Intelligence

WaterWatcher’s platform uses artificial intelligence as a core part of the Service. AI is used to transcribe your voice recordings into text, extract and structure catch data from those transcripts, generate location-specific fishing condition reports and tactical recommendations, and support pattern modeling and community matching for eligible users. In connection with this functionality, personal information may be transmitted to third-party AI service providers that process it on our behalf. AI providers process your information under contractual agreements with WaterWatcher that include appropriate data protection obligations. WaterWatcher takes commercially reasonable steps to ensure your personal information is handled by its AI service providers consistently with this policy. A list of our current sub-processors, including our AI service providers, is available at waterwatcher.com/subprocessors.

Purposes for Processing Personal Information

We may process your personal information for the following purposes.

  • Consent and direction. Based on your consent, direction, or other permission you provide to us.
  • Provide Services. Activities related to providing the Service to you, including transcribing and processing your voice recordings, performing AI-powered catch extraction and journal management, generating fishing condition reports, managing your fishing spots, delivering pattern modeling and community matching for eligible users, facilitating conservation data contributions, and improving the Services we offer.
  • Communications and engagement. To send you service-related communications and deliver notifications associated with the Service, such as morning fishing briefs, condition alerts, and account-related updates, and to respond to your inquiries and feedback.
  • Compliance, safety, and claims. To comply with applicable laws and regulations, protect our rights and interests, defend against claims, and monitor, develop, maintain, and protect the operation, security, and integrity of our platform and technology systems.
  • Analytics, research, and Service improvement. To analyze, aggregate, de-identify, and anonymize information to evaluate and improve the Service, develop new features, conduct internal research and product development, and train and improve our AI models. Information used for these purposes is de-identified or anonymized such that it does not identify you individually. If you opt into the community pool feature, anonymized catch and conditions data may be shared with other participating users to generate regional fishing pattern insights.
  • Legitimate interests. Where processing is necessary for our business operations, such as improving the Service, maintaining security, preventing fraud, resolving disputes, and operating our platform, and where those interests are not overridden by your rights and freedoms.
  • Operations. To conduct our internal operations, including administration, legal, compliance, technology, and vendor management.

Disclosure of Personal Information

WaterWatcher may disclose personal information under the following circumstances.

  • Consent and direction. To third parties you direct us to share your personal information with, or where you have otherwise provided consent or permission for us to make such a disclosure.
  • Provide Services. As necessary to provide the Service and related functionality, and to conduct our operations, including to vendors, service providers, contractors, consultants, and other third parties that assist us with technology, hosting, third-party AI providers, payment processing, authentication, email delivery, mapping, legal, accounting, compliance, and other business functions. A list of our current sub-processors is available at waterwatcher.com/subprocessors.
  • Conservation partners. Anonymized and de-identified catch and environmental observation data, which may also include event location generalized to within approximately one mile of where the event occurred, may be shared with partner conservation organizations and in fisheries science contexts under appropriate data sharing agreement, as described in the conservation data sharing section below.
  • Compliance, safety, and legal process. To comply with applicable laws and regulations, protect our rights and interests, defend against claims, and respond to valid legal process or lawful requests from governmental, regulatory, or law enforcement authorities.
  • Business transfers. In anticipation of or in connection with an acquisition, merger, consolidation, restructuring, sale of assets, or other similar corporate transaction.

Conservation Data Sharing

WaterWatcher shares catch and environmental observation data with partner conservation organizations and fisheries science initiatives as part of our conservation mission. This data is de-identified (it does not include information that identifies you, such as your name, email, or account identifier). The data we share includes species and catch details, environmental observations you make during a trip, and the location of catch, sighting, and observation events, generalized to within approximately one mile of where the event occurred. Location data shared in this context describes where a fishing event occurred, not your identity. Our conservation partners are bound by data agreements that restrict how this information may be used and prohibit the public release of specific event coordinates. You can limit or opt out of sharing of such information by submitting a request through our Privacy Rights Request Form.

In connection with tagged fish encounters, we may separately ask for your specific consent to share the precise location of the encounter and your contact information with the relevant conservation partner. This is a separate, per-event opt-in that is distinct from the general conservation data sharing described above. If you consent, we may share your name, email address, precise event location, environmental conditions, and tag details with the conservation partner for the purpose of tag follow-up and internal tagging research. You may withdraw this consent at any time by submitting a request through our Privacy Rights Request Form.

Privacy Rights

Depending on the personal information WaterWatcher processes about you and the manner in which we process it, you may have the following rights with respect to our processing of your personal information.

  • Scope of processing. Disclosure about how we process personal information, the categories of personal information we process, and the categories of sources from which such personal information was obtained.
  • Access. Access or receipt of a copy of personal information, including, if appropriate, in a portable, machine-readable, and commonly used format.
  • Correction. Rectify or correct inaccurate or incomplete personal information.
  • Deletion. Deletion or erasure of personal information.
  • Objection. Object to our processing of personal information in certain circumstances, or limit the use and disclosure of sensitive personal information, including precise geolocation data, to purposes necessary to provide the Service.
  • Withdraw consent. Withdraw consent if we rely on consent as the legal basis for processing personal information, provided that such withdrawal will not affect the lawfulness of processing that occurred before withdrawal.
  • Automated decision making. Not be subject, in certain circumstances, to a decision based solely on automated processing, including profiling, that produces legal effects or similarly significantly affects you.
  • Selling, profiling, and targeted advertising. Disclosure about whether WaterWatcher sells, shares, trades, exchanges, or brokers personal information with or to a third party for the purpose of that or any other third party using the personal information to market on their own behalf, which is referred to as “Selling”; disclosure about whether WaterWatcher uses automated decision making to evaluate, analyze or predict personal aspects related to an individual’s economic situation, health, personal preferences, interests, reliability, behavior, location, or movements, which is referred to as “Profiling”; disclosure about whether WaterWatcher targets advertising to individuals based on their activities on unaffiliated third-party websites, which is referred to as “Targeted Advertising”; and to object or opt-out of such Selling, Profiling, and Targeted Advertising.

To make a request concerning these rights, please complete and submit the Privacy Rights Request Form on our website, or contact our privacy officer using the contact information provided in this policy. WaterWatcher will respond to all complete requests within 30 days, subject to extension of that period. There may be a delay in processing a request while we verify that the request is valid and originates from a person authorized to make it.

There may be valid reasons that require or permit us to decline to honor a request, in whole or in part, including legal and regulatory requirements that we retain and process certain information. Also, honoring certain requests may limit or prevent us from providing Services to the individual about whom the request is made. In those situations, we will notify you in writing within 45 days, subject to extension of that period. You may also contact our privacy officer for information about and help with those situations.

WaterWatcher will not discriminate against you for exercising these rights or any other rights under Data Privacy Laws, including by not denying Services to you, not providing a different level or quality of Services, and not suggesting that you will receive a different level or quality of Services.

Selling, Profiling, and Targeted Advertising

WaterWatcher does not engage in Selling, Profiling, or Targeted Advertising, except with respect to tracking technologies as discussed below.

Security

We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. We store the personal information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use, or disclosure. All personal information is protected using appropriate physical, technical, and organizational measures, which may include encryption in transit and at rest, database-level access controls that isolate your data from other users, secure token-based authentication, and secure storage of system credentials.

Data Retention and Deletion

WaterWatcher retains personal information only for as long as is necessary or appropriate to achieve the purposes for which such information was collected and processed, unless a longer retention period is required or permitted by applicable law.

Website, Cookies, and Tracking Technologies

When you visit WaterWatcher’s website, we may place a cookie (a text file containing a randomly assigned number) or a similar technology on your device so we have the ability to customize the look and feel of the website for you. Cookies remember information about you, your preferences, and your device for a better user experience when visiting the website. Using cookies, we may also collect other information about your use of the website, including your Internet Protocol or IP address, username, session, browser, web pages you view and referring web pages, when you access the website, and general online behavior.

WaterWatcher may use third-party analytics tracking technologies and tools to collect information about how you use our website and application, including but not limited to, frequency of visits, pages viewed, traffic data, location, referring and exit pages, and error information. These tools may also collect device-specific data, including your IP address, operating system, browser type, and Internet connection details. These tools examine website and application activities to prepare usage reports, and this information helps us improve our platform and enhance user experience. Tracking information will be shared with the third-party analytics provider, which may use that information for its own purposes, potentially including marketing or advertising. While the tracking information we collect through such tools is not sufficient on its own for WaterWatcher to identify you, the third-party analytics provider may be able to combine it with other data it has to identify you.

If you would like to limit the ability of cookies or tracking technologies and tools to track your activity on our website, you can either configure your preferences for cookie settings on our website, or disable cookies in your Internet browser settings, although doing so may impact the performance and effectiveness of our website or other websites.

Changes to This Policy

WaterWatcher reserves the right to change or amend this privacy policy at any time. We will notify you of material changes by posting a notice within the Service and, where appropriate, by sending a notification to the email address associated with your account. Your continued use of the Service after the effective date of any updated policy constitutes your acceptance of the changes.
